It applies to buildings with three or more multifamily dwelling units and covers certain balconies, decks, porches, stairways, walkways, and entry structures that rely in whole or substantial part on wood or wood-based structural support.<\/p>\n<p>The law is about life safety and building maintenance. It is not just a paperwork requirement. Exterior elevated elements can deteriorate because water intrusion, failed waterproofing, hidden decay, corrosion, improper alterations, or age reduce structural performance over time.<\/p>\n<h2>What SB 721 Requires<\/h2>\n<p>California Health and Safety Code Section 17973 requires covered exterior elevated elements and associated waterproofing elements to be inspected. The inspection must evaluate whether the elements are in generally safe condition, in adequate working order, and free from hazardous conditions caused by fungus, deterioration, decay, or improper alteration.<\/p>\n<p>As currently stated in the code, the first inspection must be completed by January 1, 2026, and then by January 1 every six years after that. Inspection reports must be maintained in the building owner\u2019s permanent records for at least two inspection cycles and disclosed to a buyer at the time of a later sale of the building.<\/p>\n<h2>Who Is Responsible<\/h2>\n<p>The owner of the building is responsible for complying with SB 721. The person or business performing the inspection must be hired by the owner and must meet the qualification requirements in the statute, such as a licensed architect, licensed civil or structural engineer, certain qualified contractors, or a recognized certified building inspector or building official as determined by the local jurisdiction.<\/p>\n<h2>What Happens When Repairs Are Needed<\/h2>\n<p>If an exterior elevated element needs repair or replacement, the owner must correct it. Emergency conditions require immediate preventive measures, such as preventing occupant access until emergency repairs can be completed. Non-emergency corrective work requires a permit application within 120 days after receiving the inspection report, with repair timing governed by the statute and local enforcement.<\/p>\n<h2>Penalties and Liens<\/h2>\n<p>If required repairs are not completed after notice, the local enforcement agency can assess a civil penalty based on the local fee schedule. The statute sets that civil penalty at not less than $100 and not more than $500 per day until repairs are completed, unless an extension is granted.<\/p>\n<p>SB 721 also allows a building safety lien to be recorded when a civil penalty is assessed.
